Technical and Regulatory Oversight

Peak’s Licensed Site Remediation Professionals (LSRP) and technical staff manage regulatory requirements of each project under N.J.A.C. 7:26C Administrative Requirements for the Remediation of Contaminated Sites by providing an LSRP, who is subject to the Rules of Professional Conduct detailed in Subchapter 6 of N.J.A.C. 7:26I Regulations of the New Jersey Site Remediation Professional Licensing Board. Once NJDEP receives payment of any outstanding fees (if required), Peak prepares and submits the NJDEP Online LSRP Notification of Retention Form notifying the NJDEP that a Peak LSRP has been retained to manage the project. The LSRP oversees the project from a regulatory perspective by identifying applicable regulations, identifying project specific regulatory timeframes, and developing tasks necessary to maintain compliance.

Depending on site complexity and presence of receptors, a Site Visit is conducted to discuss the project with site representatives, and become familiar with the property layout and features, current operations, location of impacted area.

Peak also coordinates submittal of an Annual Remediation Fee (ARF) form, which is required for all regulated sites, through NJDEP Online. Fee amounts are based upon NJDEP’s Fee Guidance Document (July 1, 2015; Version 2.1) and procedure in N.J.A.C. 7:26C-4.3(d) and -4.3(e).

Peak also maintains a NJDEP Case Inventory Document (CID), required by N.J.A.C. 7:26E-1.6(a)3, for each site. The CID is a list of all environmental areas of concern (AOC) identified to date with relevant technical specifications, associated hazardous materials, whether there has been a release, and the status of remediation of the release. An updated CID is typically required with each report submittal.

N.J.A.C. 7:26C requires submittal of NJDEP forms with Remedial Phase Reports. The forms require detailed site administrative information and technical data in specific formats. The LSRP must review forms and sign a certification document that accompanies the forms.

Oversight and preparation of numerous regulatory submittals, such as a Receptor Evaluation, Public Notification, a Classification Exception Area, a Deed Notice, a Remedial Action Permit, and underground storage tank closure, are typically required on Site Remediation projects.
