Biennial Certifications

NJ Biennial Certifications

As required by New Jersey statute and regulations, Peak provides a Licensed Site Remediation Professional (LSRP) to oversee activities at site where hazardous materials have been released, and to ensure regulatory requirements for site characterization and remediation are met. An LSRP must also oversee compliance monitoring pursuant to Remedial Action Permits (RAP) at sites where contaminants remain in place under institutional and engineering controls.

For soil, a deed notice is the typical institutional control, and engineering controls, when needed, typically include impermeable caps (concrete building slabs and asphalt parking and roadways), semi-permeable landscape caps and vegetative caps, depending on the contaminants present and the use of the property.  For groundwater, a Classification Exception Area (CEA) is the typical institutional control, and engineering controls, if present, typically consist of groundwater remediation equipment.

RAPs require periodic inspections of engineering controls, a review of relevant regulations, and a submittal to NJDEP every two years certifying that the selected controls remain protective. Peak’s experienced technical staff conduct inspections with photo-documentation of these features to verify information in institutional controls, and to evaluate the integrity of engineering controls and identify repairs or other necessary maintenance tasks.

For soil, the biennial certification process consists of the following tasks.

    • Inspect engineering controls and document.
    • Determine whether actual or pending zoning or land-use change is consistent with the use restrictions in the deed notice or declaration of environmental restrictions.
    • Compare laws, regulations and standards applicable when the controls were established with current requirements to determine whether subsequently promulgated or modified laws, regulations, or standards affect the permit.
    • Consolidate maintenance or improvement documentation, completed since the implementation of the remedial action.
    • Complete the NJDEP Soil Remedial Action Protectiveness/Biennial Certification Form and prepare a draft submittal package, including photo-documentation, periodic inspection forms, records of disturbances/restoration, changes in SRS, and other pertinent information. The draft submittal package will be sent to Client for review and signature.
    • Certify and submit the final biennial certification packages to the NJDEP.

For groundwater, the biennial certification process consists of the following tasks.

    • Report the results of the required groundwater monitoring
    • Evaluate whether the extent of longevity of the existing Classification Exception Area (CEA) requires revision
    • Conduct an updated potable well search within the NJDEP-specified search radii
    • Compare laws, regulations and standards applicable when the controls were established with current requirements to determine whether subsequently promulgated or modified laws, regulations, or standards affect the permit
    • Inquire from municipal and County governments whether any changes to the water use plan in the vicinity of the Site are anticipated
    • Complete the NJDEP Groundwater Remedial Action Protectiveness/Biennial Certification Form and prepare a draft submittal package, including laboratory data, records of new water wells, changes in remediation standards, and other pertinent information. The draft submittal package will be sent to Client for review and signature
    • Certify and submit the final biennial certification package to the NJDEP
